Official Rules ("Official Rules")

The Bridgestone Rivals – Race to the Top 2024 (“Competition”) is organized by Bridgestone Asia Pacific Pte Ltd with its registered address at 83 Clemenceau Avenue, 8th Floor, Singapore 239920 ("Bridgestone").
By entering the Competition, all Racers accept and agree to abide by these Official Rules and Racing Rules (as defined below). Registration is required in order to participate in the Competition.
The prizes shall include an item worth up to Usd1,000, among other prizes to be solely determined by Bridgestone (collectively hereinafter defined as “Prizes”) will be awarded in compliance with the Official Rules and Racing Rules.
1. RACERS ELIGIBILITY
1.1 Registration Period(s); Acceptance of the Official Rules and Racing Rules
To participate in the Competition and to qualify for the Prizes, Racers must;
a) Comply with entry requirements for the Competition as published at www.bridgestonerivals.com;
b) Accept the stated terms and conditions located within the racing simulation video game known as “Forza Motorsport”, the eighth edition, including any version updates made thereto from time to time(“Game”) – including but not limited to accepting and acknowledging that "By participating in this event, you (the Racer) consent to sharing the gamertags, email addresses, location with Bridgestone and its affiliated companies” and to be contacted by Bridgestone or its affiliated companies regarding the Competition;
c) Register with Bridgestone by signing up at www.bridgestonerivals.com and complete the necessary registration and relevant forms related to the Prize offering, which are required by Bridgestone to be eligible for the Prizes;
d) Have a valid Game Pass subscription and valid copy of the Game or valid license to play the Game at the time of the Competition and during the Registration Period as stated below;
e) be of at least 18 years old or have reached the minimum age to enter into contract by themselves without parental consent under the laws applicable to the location as registered in their Game Pass subscription account, whichever is older, at the time of registration;
f) submit their race times in accordance with the rules or guidelines that Bridgestone may publish and update from time to time at www.bridgestonerivals.com; and
g) To qualify for the Prizes, a minimum of two (2) registered Racers are required in any applicable Eligible Country.

Racers must fulfill all the conditions stated above and all registration forms must be completed and received by Bridgestone within the Registration Period.
By submitting a registration form and by participating in the Competition, Racers agree that they (i) are eligible to register and participate; (ii) will have read and accepted these Official Rules, the Racing Rules and (ii) the Bridgestone Privacy Policy. Racers agree to be bound by these Official Rules, the Racing Rules, and the decisions of Bridgestone in the context of the Competition. Racers acknowledge that Microsoft and any other Bridgestone partners' or contractors’ activities are governed by their respective terms and conditions and privacy policies. Bridgestone takes no responsibility for any terms of use or policies other than its own. Racers agree that Bridgestone reserves all rights and has full discretion to disqualify a Racer if they violate any of the terms of the Official Rules, the Racing Rules or if their conduct is contrary to the spirit or good standing of the Competition.
Bridgestone reserves the right:
a) To alter, amend or supplement these Official Rules and Racing Rules from time to time as it deems fit;
b) To cancel, change or suspend the Competition, or any part of it, if cheating, a virus, bug, or any other unforeseen or unexpected event that affects the conduct, safety, fairness and/or integrity of the Competition.
c) To modify, suspend, postpone, or discontinue, temporarily or permanently, at any time and from time to time, the Competition, or any part of it, with or without prior notice, for reasons outside its reasonable control, including, without limitation, any Force Majeure event (as Force Majeure is defined in Section 5.7).
1.2 Residency
Racers must be legal residents in an eligible location to participate in the Competition. Schedule 1 shows a list of all eligible locations and their corresponding regional classification (“Eligible Location”).
1.3 Bridgestone Employees; conflict of interests
The officers, directors and employees of Bridgestone and of its subsidiaries and affiliated companies (collectively, “Bridgestone Employees”), Microsoft, Turn 10 Studios, their subsidiaries and affiliated companies, as well as all advertising, marketing and judging agencies, persons engaged in the development, production or distribution of materials for this Competition, any individual or company engaged by Bridgestone or its affiliated companies to provide endorsement or related services, and immediate family members (parents, step-parents, grandparents, children, step-children, siblings, civil partners or spouses), persons living in the same household (whether related or not) of all of the foregoing (all of the foregoing excluding Bridgestone Employees shall collectively be referred to as “Non-Bridgestone Employees”) shall be eligible to participate in this Competition, PROVIDED THAT: (i) in the case of Non-Bridgestone Employees, their participation shall not be eligible for any Prizes whatsoever; (ii) in the case of Bridgestone Employees, their eligibility for Prizes shall exclude a grand prize worth up to Usd1000, where their eligibility for Prizes shall be governed by the rules prescribed by internal activation events held by Bridgestone and its affiliated companies.
2. REQUIREMENTS TO PARTICIPATE
2.1 Right to Verify Eligibility
Racers shall provide proof of eligibility. Bridgestone and its affiliated companies reserve the right to verify the eligibility of Racers (including but not limited to any minimum age requirements, legal residency, or other requirements pursuant to the laws and regulations of the Eligible Location) at any time during the Competition to the extent required for the purposes of the Competition by requesting the Racers to produce any documentation of eligibility as Bridgestone and its affiliated companies deem fit. Following Bridgestone’s and its affiliated companies’ verification of documentation of eligibility (if any) provided by the Racers, Bridgestone and its affiliated companies reserve the right to disqualify and reject eligibility of the Racers for participation in the Competition or remove the right to receive Prizes to winners for any reason whatsoever.
Failure to adhere to such verification procedures will result in disqualification from the Competition and/or withdrawal of the Prizes.
2.2 Invalid Entries
Bridgestone and its affiliated companies will not accept Competition entries that are:
a) automatically generated by computer;
b) completed by third parties or in bulk;
c) illegible, have been altered, reconstructed, forged or tampered with; or
d) incomplete.
Further, Bridgestone and its affiliated companies will reject any Competition entry made using a gamertag that is not associated with the Game Pass account that the Racer has registered with Bridgestone through www.bridgestonerivals.com.
2.3 Entries per Person
Each Racer may only participate in the Competition under one account. Competition entries on behalf of another person will not be accepted and joint submissions are not permitted.
2.4 Photographs, Audio and Video
Racers agree to be interviewed, photographed, and filmed during any or all stages of the Competition, and hereby grant Bridgestone, its group companies and their licensees the unfettered right and entitlement to broadcast, publish, license, use and exploit any photographs, films, recordings, images, resulting footage, streams, stills, audio and quotes including for their own broadcasting and advertising purposes in connection with the Competition, in perpetuity, in any and all media. The consideration for the granting of the rights provided herein is Bridgestone granting access to participate in the Game upon registration at www.bridgestonerivals.com and eligibility for the Prizes, as a result of completion of the necessary forms related to the Prize offering.
3. DISCLAIMER
Bridgestone will not accept:
a) responsibility for Competition entries and forms that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind;
b) proof of posting or transmission as proof of receipt of an entry to the Competition; or
c) responsibility for any delay, time lag, slow response, congestion of data transmission or slow connection related to the Competition or to in-game activity and actions (including racing-related actions), for example, due to remoteness of the server(s) or poor internet connection.
4. PRIZES
a) Prizes will be granted only if participating Racers fully comply with these Official Rules and Racing Rules. In case of breach of any provision of these Official Rules and Racing Rules by Racers, they will be disqualified from the Competition and lose any right to receive the Prizes indicated in the Racing Rules.
b) Bridgestone or its affiliated companies will contact the winners to notify them of the necessary logistics arrangements for the redemption of the Prizes, such logistics arrangements to be determined at Bridgestone’s or its affiliated companies’ sole discretion. Bridgestone and its affiliated companies are not liable for any damage (whether lost, stolen, forged or tampered with) or delay occurring in the transit of Prizes. In the event of any damage or defect whatsoever, the winner shall contact the manufacturer of the product. Prizes are not transferable, refundable or exchangeable to accommodate the preferences of the winners, and must be accepted as awarded in respect of the services performed and cannot be resold for profit. Any taxes and any duties on the Prizes are the winners’ sole responsibility.
c) Bridgestone reserves the right to alter, change or replace the Prizes, without any prior notice and at any time, with a prize of a similar value, as it deems fit.
d) Bridgestone will make all reasonable efforts to contact the winners of the Prizes as soon as practicable after the announcements of the winners.
e) The winners of the Prizes will have seven (7) days from notification to claim the Prizes as instructed in their notification email and to sign the relevant forms related to the Prize offering as required by Bridgestone. If the said forms are not signed and the Prizes are not claimed within the said seven (7) day period, the Prizes will be considered forfeited. The Prizes may not be claimed by a third party on behalf of the winners. Bridgestone reserves the right to offer the unclaimed Prizes to the next eligible Racer and/or void unclaimed Prizes.
f) Winners who acknowledge acceptance of Prizes within the seven (7) days’ period will have thirty (30) days after the seven (7) days’ period to provide Bridgestone and its affiliated companies with proof of all applicable documentation including but not limited to signed forms related to the Prize offering (“Prize Eligibility Documents”) as outlined in Section 4(e) or as may be requested by Bridgestone or its affiliated companies in accordance with Section 2.1. In the event Winners fail to produce the Prize Eligibility Documents within the thirty (30) days’ period, the winner acknowledges and accepts forfeiture of the Prize, in which instance Bridgestone and its affiliated companies reserve the right to offer forfeited Prizes to the next eligible Racer and/or void the Prize
g) Bridgestone does not accept any responsibility if the winners are not able to receive their prizes.
h) Bridgestone and its affiliated companies reserve the right to withhold Prizes from the winners, upon reasonable and justifiable grounds.
5. LIMITATION OF LIABILITY
a) In so far as permitted by law, the Prizes are provided 'as is' without any warranties of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
b) Insofar as is permitted by law, Bridgestone their agents or distributors will not in any circumstances be responsible or liable to compensate the winners or accept any liability for any claims, demands, damages, liabilities, costs or expenses of any kind, whether direct, indirect, consequential, incidental, or special, including but not limited to personal injury, property damage, or loss of use occurring as a result of participating in the Competition or in connection with or taking up the Prizes, whether the claim is based in contract, tort (including negligence), strict liability, or otherwise. Furthermore, Bridgestone, their agents or distributors disclaim any liability regarding any certifications, authorizations or contests authorization related to the Competition or eSports.
c) Bridgestone, their agents or distributors accept no responsibility for any costs associated with any prizes or participation in the Competition that are not expressly stated to be their responsibility in these Official Rules. Additionally, each winner of a Prize is solely responsible for all applicable federal, state and local taxes, including taxes imposed on its income.
d) Winners agree to use the Prizes at their own risk. Bridgestone, their agents or distributors shall not be responsible for any loss, damage, or injury that may result from the use or possession of the Prizes.
e) Bridgestone, their agents or distributors shall have no liability whatsoever for any injury or damage to any Racer or any other person’s computer or console, relating to or resulting from participation in or downloading any materials in connection with the Competition.
f) Winners agree to indemnify, defend, and hold harmless Bridgestone, its officers, directors, employees, agents, licensors, suppliers, and any third-party information providers to the Prizes from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of this disclaimer by a winner or any other person having possession or use of the Prizes.
g) Bridgestone, their agents or distributors shall not be liable for any failure to comply with their obligations relating to the Competition where the failure is caused by something outside their reasonable control or force majeure (“Force Majeure”). Such Force Majeure shall include, but is not limited to, epidemic, pandemic, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure.
6. OWNERSHIP OF COMPETITION ENTRIES AND INTELLECTUAL PROPERTY RIGHTS
a) By submitting a Competition entry and any accompanying material, the Racer agrees with Bridgestone's commitment to assign the Prizes in compliance with these Official Rules to:
i. assign to Bridgestone and its affiliated companies all intellectual property rights with full title guarantee; and
ii. waive within the limits provided by applicable laws in the country of Racer’s residence - all moral rights in and to the Racers competition entry and otherwise arising in connection with the Racers entry to which the Racers may now or at any time in the future be entitled under all applicable legislations. Any statutory diverging rights are not affected.
b) The Racer agrees that Bridgestone may, but is not required to, publish winners’ names and prizes received on any relevant website and any other media, whether now known or invented in the future, and in connection with any publicity of the Competition. The Racer agrees to grant Bridgestone a non-exclusive, worldwide, irrevocable license, for the full period of any intellectual property rights in the Competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, reformat and sublicense the Competition entry and any accompanying materials for such purposes.
c) Racers shall not associate themselves with the Competition in any commercial manner, nor use any intellectual property rights of Bridgestone and its affiliated companies, nor modify, adapt, translate or create derivative works from the intellectual property of Bridgestone and its affiliated companies, nor shall they permit any third parties to do so, without the prior written consent of Bridgestone and its affiliated companies. The recording, dissemination, or any exploitation of images of the Competition without Bridgestone's and its affiliated companies’ prior approval is strictly prohibited.
7. DATA PROTECTION AND PUBLICITY
7.1 Warrant and Confirmation.
Racers warrant that they have carefully read this Section 7 (“Bridgestone Privacy Notice”), which explains how Bridgestone and its affiliated companies collect, use, share, and disclose Racers’ personal information during the Competition, and the measures that Bridgestone and its affiliated companies have put in place to protect the data privacy of Racers. Racers acknowledge and agree to (i) Bridgestone’s and its affiliated companies’ collection from Microsoft and processing of the Racers’ gamertag IDs; (ii) Bridgestone’s and its affiliated companies’ collection from Racers and processing of the Racers’ email addresses and their location; (iii) Microsoft Corporation’s or its affiliated companies’ (“Microsoft”) verification and substantiation of these Racers; and (iv) Bridgestone and its affiliated companies collecting and receiving from Microsoft, and Microsoft correspondingly disclosing to and sharing with Bridgestone and its affiliated companies the rankings by racing time in each Eligible Location; and (iv) Bridgestone and its affiliated companies processing Racers’ personal information (whether disclosed by Microsoft or submitted directly to Bridgestone and its affiliated companies via www.bridgestonerivals.com) in accordance with this Section 7 for the purposes set out below or as otherwise required or permitted under applicable laws.
The Racers hereby acknowledge, agree and accept that the collection, processing and disclosure of their personal information (whether by Bridgestone or Microsoft) under the Bridgestone Privacy Notice and this Section 7 is necessary, reasonable and appropriate for Bridgestone to organize, administer, conduct and publicize the Competition, including but not limited to:
(a) verifying the Racers’ eligibility to participate in the Competition and to qualify for the Prizes for each Eligible Location;
(b) verifying the Racers’ achievement and rankings in the Competition;
(c) corresponding with the Racers for the purposes of the Competition;
(d) determination and announcement of the winners in each Eligible Location;
(e) broadcasting, advertising and any other form of publicity deemed appropriate for the Competition;
(f) delivery of the Prizes; and
(g) any other purpose that is necessary for Bridgestone to discharge its obligations under the Official Rules or as otherwise required or permitted under applicable laws.
7.2 Collection and Use.
Racers hereby acknowledge, agree to and accept:
7.2.1 Bridgestone and its affiliated companies’ collection, use and processing of Racers’ personal information during the Competition whether collected directly from Microsoft, Racers or otherwise, including but not limited to when Bridgestone or its affiliated companies process Racers’ personal information to determine the winners, verify the Racers’ achievement with Microsoft, arrange for the Prizes to be delivered and publish winners’ names and Prizes received on any relevant website or any other media and when a Racer uses Bridgestone and its affiliated companies’ products and services, such as when a Racer receives services from Bridgestone or its affiliated companies;
7.2.2 Bridgestone and its affiliated companies’ use of the Racers’ information to ensure the proper operation and administration of the Competition, conduct promotional giveaways and to provide Bridgestone and its affiliated companies’ products and services for or to the Racers;
7.2.3 Bridgestone and its affiliated companies’ use of the information of the Racers collected for publicity purposes; to notify Racers of their standing and outcome in (e.g. having won) the Competition, to arrange for collection of a Prize, to notify or effect updates to the Competition (such as when the Competition closes), and to let Racers know of special promotions, events and policy changes, including using emails, text messages and push notifications; and
7.2.4 Bridgestone and its affiliated companies’ collection, use and processing of aggregated and/or statistical data reflecting the Racers’ participation in the Competition, for tracking, reporting, and other activities in connection with Bridgestone and its affiliated companies’ business, and/or in accordance with Bridgestone's Privacy Notice.7.3 Sharing and Disclosure.
7.3 Sharing and Disclosure.
Bridgestone does not trade, rent, or sell Racers’ personal information to unaffiliated companies, save and except that Racers agree that Bridgestone may share Racers’ personal information as necessary, with its affiliated companies, third party service providers to process Racers’ personal information on Bridgestone’s behalf, and partners involved in the Competition; to provide any operations or support to products and services requested or authorized by the Racer; or with third party providers, vendors and operators of the Prizes. Without limitation, partners involved in the Competition include Microsoft and Turn 10 Studios. Racers should read and familiarise themselves with the privacy policies of these partners as may be applicable, and Bridgestone does not assume any responsibility for these partners’ compliance with such policies and/or applicable laws. Where notification is required under the laws of applicable Eligible Locations, Racers hereby acknowledge its receipt and notice of Bridgestone’s data privacy policy, where applicable.
7.4 Storage of Information.
Bridgestone and its affiliated companies may store and process personal information of Racers in any country Bridgestone or its affiliates, subsidiaries, or its service providers maintain facilities for a period of either one (1) year from the date of collection or for as long as may be required for legal or business purposes, whichever is longer. Bridgestone takes steps to ensure that the personal data it collects is processed in accordance with the Bridgestone Privacy Notice, the Official Rules, and applicable laws including in the Eligible Locations.
8. GENERAL
a) If there is any reason to believe that there has been a breach of these Official Rules and/or the Racing Rules, Bridgestone may, at its sole discretion, reserve the right to exclude the Racer from participating in the Competition.
b) All decisions regarding the interpretation of these Official Rules, Racing Rules, eligibility, scheduling and staging of the Competition lie solely with Bridgestone (and anyone acting on its behalf), whose decisions are final. Unless otherwise provided for in the mandatory applicable laws of Racer’s country of residence that cannot be derogated from by agreement, Bridgestone’s decisions cannot be appealed and shall not give rise to any claim for monetary damages or any other legal or equitable remedy. Racers agree to be bound by Bridgestone’s (and anyone acting on its behalf final decisions.
c) Bridgestone reserves the right to hold void, suspend, cancel, or amend the Competition where it becomes necessary to do so.
d) If any provision of this Agreement is held to be illegal or invalid for any reason, the illegality or invalidity shall not affect the remaining provisions hereof, but such provision shall be fully severable and this Agreement shall be construed and enforced as if the illegal or invalid provision had never been included herein.
e) Unless otherwise provided for in the mandatory applicable laws of Racer’s country of residence that cannot be derogated from by agreement, these Official Rules shall be governed by the laws of Singapore , and any dispute arising out of or in connection with the Official Rules, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre in accordance with the Arbitration Rules of the Singapore International Arbitration Centre for the time being in force, which rules are deemed to be incorporated by reference in this clause. The seat of the arbitration shall be Singapore. The Tribunal shall consist of one (1) arbitrator. The language of the arbitration shall be in English.
f) The Official Rules shall be translated and available in local language depending on the requirements of the Eligible Locations; provided always that the Racer hereby agrees that in the event of any inconsistencies between the local language version and this English version, the English version of the Official Rules shall always prevail, and the local language version of the Official Rules shall not be construed in any manner whatsoever as superseding, replacing or amending the English version thereof. Only the English version of the Official Rules is considered official. All translated versions into local language are unofficial and are for reference only.
